Spain has officially enforced a groundbreaking law aimed at ensuring the ethical use of artificial intelligence (AI), marking a significant step in regulating this transformative technology. This move is part of Spain's broader National AI Strategy and aligns with the European Union's AI Act, reinforcing the country’s commitment to fostering responsible innovation while safeguarding fundamental rights.


The legislation emphasizes transparency, accountability, and human oversight in AI applications. It mandates that high-risk AI systems undergo rigorous testing in controlled environments, known as regulatory sandboxes, before deployment. These sandboxes provide companies with an opportunity to refine their systems while adhering to ethical guidelines and minimizing risks to users.


A cornerstone of this initiative is the Spanish Agency for the Supervision of Artificial Intelligence (AESIA), Europe’s first dedicated AI supervisory body. AESIA is tasked with monitoring compliance, mitigating risks, and promoting awareness about the ethical implications of AI technologies. The agency also collaborates with the Ministry of Economic Affairs and Digital Transformation to oversee sandbox projects and ensure alignment with EU standards.


The law also addresses specific challenges posed by emerging technologies like deepfakes and algorithmic decision-making. It includes provisions to protect privacy, self-image, and honor, particularly in cases where AI recreates human voices or images without explicit consent. Additionally, it establishes mechanisms for public participation through newly created advisory councils that include representatives from civil society.


Spain’s proactive stance on AI regulation reflects its leadership role during its recent presidency of the European Union Council. The country has also been instrumental in fostering international cooperation on AI governance, hosting events that bring together stakeholders from Europe, Latin America, and beyond.


The enforcement of this ethical framework is expected to bolster public trust in AI systems while encouraging innovation across sectors such as healthcare, education, and public administration. By setting a high standard for responsible AI use, Spain is positioning itself as a global leader in balancing technological advancement with societal values.
